冲着“使命必达”这句铿镪有力的电视广告宣传语，许多中国消费者放心地选择了联邦快递公司，作为自己心爱物品的快递商。然而，联邦快递频频丢失所托运物品，让生活在以“一诺重千金”为荣的国度里的中国消费者备感迷惑，中国消费者质疑：联邦快递的“使命必达”，到底是诺言，还是谎言？

不要压，不要挤，不要扔

北京28岁的小伙子王晖，就是被联邦快递“使命必达”宣传搞迷糊了的消费者之一。他通过中国消费者报（微博)与腾讯网联合主办的315消费投诉官方微博，反映了自己的闹心遭遇。2010年10月9日，受一位河南朋友委托，王晖通过电子邮件排队，在北京西单大悦城苹果官方旗舰店，买了一部黑色iphone4手机，16G，价格为4999元。购机款河南朋友此前已预支给王晖，为了取信于朋友，王晖连新买的iphone4外包装都没有打开过。10月14日，王晖放心地外包装完好的iphone4手机连同自己的信任，一起交给了联邦快递公司的取件员。

在交付iphone4手机前，王晖曾致电联邦快递客服，问手机能不能快递，接电话的客服人员称可以，问可否快运，客服人员建议用“普快”。在将手机交付联邦快递的取件员时，王晖反复交待这手机“不要压，不要挤，不要扔”。对王晖的“三不要”，取件员痛快答应了。

抱着对联邦快递“使命必达”承诺的信任，王晖开始了漫长的等待。然而，十多天后，王晖并没有等来“使命必达”的喜讯，相反，他只等来了“所托运物品已丢失”的电话通知。这位憨厚的小伙子方寸大乱，他这时才意识到，他只顾着交待投递过程的“三不要”，但在物品最基本安全性都无法提供保证的情况下，他苦口婆心的“三不要”，又有什么意义？

100元赔偿IPHONE4、笔记本电脑、24万元的视讯设备

12月22日，一纸轻飘飘的传真纸，来到了王晖的面前。这是联邦快递公司给王晖的索赔要求答复函。函件中只字未提iphone4手机丢失的经过，只是通知说“您的此票件最终处理结果，我们将赔付100元，并退还此票件货物全部运费28元，共计128元。”拿着这张传真纸，王晖四顾茫然。2天后，王晖在接受赔款人一栏里，心情复杂地签上了自己的名字。事后他告诉本报记者：“100元赔偿是少了点，但比一分钱拿不回来稍强点。我没有办法，我只是一个普通的工薪族，我斗不过他们。”

100元赔偿违心地接受了，王晖的煎熬其实刚刚开始。河南的朋友不催他还钱，但总是将iphone4的新闻时不时地发给他。“凡出言，信为先”，对这位接受中国传统文化成长起来的小伙子来说，他实在想不明白，一个跨国企业，通过广告形式向全国消费者做出的“使命必达”承诺，怎么如此不可信？

如果王晖在网上搜索一下，并了解同城消费者张先生的遭遇，相信他对联邦快递"使命必达"的诺言，一定会有新的认识。据中国法院网报道，2009年1月16日，张先生电话通知联邦快递公司将一台笔记本电脑快递至宁波。当天下午，联邦快递公司工作人员上门将笔记本电脑取走。2009年1月18日下午，张先生打电话查询快件，联邦快递公司告知张先生快件已经送达宁波，正在抓紧时间送给客户。2009年1月20日，联邦快递公司吴***致电张先生，笔记本电脑在运输过程丢失，按照公司规定每公斤赔偿20元，要求张先生去其公司领取100元的赔偿款，并在后来以电子邮件形式发来道歉信。

与王晖和张先生相比，北京汉唐自远技术有限公司对联邦快递“使命必达”的认知，应该更刻骨铭心。据北京法院网报道，2008年10月23日，汉唐自远公司委托联邦快递将一台价值24万元的视讯终端从北京托运至重庆，按照双方约定，上述货物应该在2008年10月24日运抵目的地。但直至10月27日，收货方仍未收到货物。经过联系，汉唐自远公司被告知货物在运输途中不慎丢失，联邦快递正在查找。此后，汉唐自远公司多次询问查找进展，联邦快递均告知还在查找中，还没有找到。在焦急地等待多日，货物仍然杳无音信的情况下，汉唐自远公司向联邦快递提出索赔，但联邦快递给出的答复却是，由于汉唐自远公司托运的货物没有办理保价，最多只能赔偿200元。2009年4月，汉唐自远公司将联邦快递诉至北京海淀法院，此案最后以调解告终。汉唐自远公司损失惨重。

“合同条款”得以免责？

2010年1月10日，联邦快递企业传讯部给中国消费者报记者发来电子邮件，对王晖投诉一事作了解释，邮件称：“让客户满意是联邦快递最优先考虑的事情。联邦快递在中国始终致力于为客户提供迅速、可靠的递送服务。联邦快递对此事件给客户引起的任何不便表示遗憾。我们也已经和客户进行了沟通，并按照公司相关政策和合同条款对该客户给予赔偿。”

联邦快递回复，如同其“使命必达”承诺一样，在频频丢失的托运物品面前，显得比任何时候都苍白无力。在丢失贵重物品后，联邦快递究竟作了哪些改进工作？丢失了价值4999元iphone4手机后，联邦快递又依据什么只给消费者100元赔偿？联邦快递理直气壮的所谓“合同条款”，真的可以让其在丢失物品面前免责吗？
