Justice of the state of Rio de Janeiro (Southeast Brazil) claimed the
right fertilizers five people at the Maracana to attend World Cup
games-2014, disavowing an agreement signed with FIFA, on Saturday a
local website.
According to the Estado-portal media group state,
plaintiffs initiated an action against the state of Rio de Janeiro,
owned by the legendary stadium, since they were not recognized them
their subscriptions to witness major international tournaments after
extensive refurbishment suffered the complex.
Thus, plaintiffs
Brazil-England friendly which served reopening the Maracana were lost,
and matches of the Confederations Cup in June.
Judge Luciana Oliveira
Martins da Cunha Rio ordered the government to pay a compensation of
6,500 reais ($ 2,800 to change), plus the value of the tickets of the
parties that were denied access and its attorney fees.
In addition, he gave the right to all games "FIFA events" at the Maracana, including the World, Estado said.
When
he was appointed to host the World-2014, Brazil signed an agreement
with FIFA whereby ceded management facilities during the Confederations
Cup in June, and the World (12 June to 13 July).
Under the agreement,
the owners of seats and boxes have no right to enter the stadium under
the administration of the world body of soccer.
"It happens that the
standards set out in the said laws that prevent the use of the
plaintiffs to their chairs should be considered unconstitutional because
they go against the vested right and perfect legal act relating to the
contract concluded in the late 40s that reveals the right to use other
chairs without charge "justified Oliveira.
He further noted that the
applicants signed the 'Stadium Agreement "and that" the State has no
power to represent the city to remove their rights. "
These chairs
were sold in the late 1940s to finance the construction of the Maracana
for the World Cup 1950. The titles were valid for five years, but two
years later, that became a law in perpetual right to the payment of an
annuity.
So, those seats became a transferable property only with the
death of its owner. Currently, at Maracan?-with a capacity of 78,838
spectators and the stage of the World Cup final-2014-perpetual there are
5,000 seats, according to the specialized site Globo Esporte.
Last
week, FIFA was fined by the body of consumer protection (Procon) from
Brazil with $ 210,000 after complaints from viewers who had problems
with their game tickets Spain-Uruguay, for the Confederations Cup on 16
June last in Recife (northeastern Brazil).
