Two men are expected to be arraigned today on felony charges accusing them of shining a laser pointer at two commercial airplanes approaching Port Columbus and a Columbus police helicopter on Monday night.

Fairfield County resident Dennis J. Smoke, 45, of 4835 Blacklick Eastern Rd. in Liberty Township, was arrested yesterday with Levi M. Milstead, 19, of Lowell in Seneca County in northwestern Ohio. Each is being held in Fairfield County jail in lieu of $50,000 bond, Sheriff Dave Phalen said.

Smoke and Milstead are each charged with two counts of interfering with the operation of an aircraft with a laser, a seconddegree felony, and one count of possession of criminal tools, a fifthdegree felony. Conviction on the more serious charge carries a maximum penalty of eight years in prison, Phalen said.

Nationwide, reported incidents of people shining lasers at aircraft have increased. The number has risen from roughly 300 in 2005 to more than 750 last year and 730 through July of this year, said Lynn Lunsford, a spokesman for the Federal Aviation Administration.

"It's obviously something that the FAA takes very seriously," Lunsford said. Pilots have complained about being temporarily blinded by a laser light hitting the cockpit, he said.

The pilot of a Columbus police helicopter saw the laser coming from a car at Blacklick Road and Cherry Lane in Fairfield County. Pataskala police officers caught the car at a gas station along Rt. 310 near I70, found the laser pointer inside and turned the suspects over to Fairfield County, where the alleged offenses occurred, Phalen said.

The laser device is the diameter of an index finger and about 6 to 8 inches long. It gives off a stronger, brighter beam than the laser pointers commonly used in classrooms or offices, Phalen said.
