They didn’t win then, but they probably will win eventually. That’s politics.
But when a court declares, as that Iowa court did, that a "right" to same-sex marriage has materialized in a constitution that mentions no such thing, then the voters are entitled to take advantage of a constitutional right explicitly listed in the constitution. Iowa voters did so.
We Jersey voters don’t have that right. But if we did, consider how that might have affected one of the New Jersey Supreme Court’s greatest intrusions into politics, the decisions in the long string of zoning cases known collectively as Mount Laurel.
